This Advertising, Listing & Sponsored Content Policy (“Policy”, “Agreement) governs all advertising, sponsorships, paid features, and promotional content across FirstFive Magazine platforms, including the webzine, website, business directory, email newsletters, and social media (the platform”, “Our platform”, “FirstFive”, “FirstFive Magazine”). It also governs the FirstFive Magazine Business Directory; a paid listing platform designed to feature businesses, professionals, and experts aligned with our mission of supporting love, marriage, and family life in the first five years. By engaging in an advertising, listing or sponsored content, you enter into a legally binding agreement between you ("User", “business”, "you", or "your") and Firstfive Marriage World Ltd ("we", "our", or "us") governing your access to and use of our promotional and other related services.
SECTION 1: PAYMENT & LISTING TERMS
1.1 Paid Placements
All directory listings, ads and promotions are paid placements, and will be clearly identified as sponsored, a paid feature, an advertisement, or partnership content. We do not disguise paid content as editorial content.
1.2 Eligibility
To qualify for a listing, businesses must:
- Operate legally in their jurisdiction
- Provide accurate and truthful information to their audience
- Align with the values and mission of FirstFive Magazine
1.3 No Guarantee, No Endorsement
- Payment for listings or advertisements does not guarantee sales, leads, engagement, search ranking, or visibility beyond platform design. We do not guarantee sales, leads, engagement, click-through rates, or audience conversion through listings.
- Listing in the directory or placing an d on our platform does not constitute endorsement, recommendation, certification, or partnership with/by FirstFive Marriage World LTD.
1.4 Third-Party Appearances
Advertising may also appear on third-party platforms such as LinkedIn. We are not responsible for algorithm changes, reach fluctuations, platform downtime, or policy changes on those platforms
SECTION 2: CONTENT & EDITORIAL CONTROL
2.1 Submission Standards
Businesses are responsible for ensuring all submitted content is accurate, not misleading, not defamatory, and not infringing on third-party rights.
2.2 Approval and Removal
- We reserve the right to approve or reject listings, edit submitted content, and suspend or remove listings without prior notice. Reasons may include policy violations, complaints, or misrepresentation.
- We reserve the right to reject advertisements that include false or misleading claims, offensive or harmful material, content inconsistent with the Christian values of FirstFive Magazine, or illegal products or services.
2.3 Editorial Control
We reserve full editorial control over the placement, formatting, timing, and presentation of sponsored content. We may edit listings for clarity or compliance.
SECTION 3: SUBSCRIPTION & PAYMENT TERMS
3.1 Advertising and Listing Packages
Listings may be recurring or one-time, depending on the selected package.
Failure to renew payment for recurring listings may result in removal.
3.2 Payment Processes
- The prices for ads, listings, and recurring subscription plans are set out on our Pricing page, and may be updated from time to time. All fees are stated in the currency displayed at the time of purchase. Taxes will be added to the fee, and a total will be deduced at checkout.
- Payments are processed by third-party payment providers. By providing your payment details, you authorise us to charge the applicable fee to your selected payment method. We do not store your full payment card details; these are handled securely by our payment processor under PCI-DSS compliant standards.
3.3 Refund Policy
- You may cancel your recurring subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.
- We do not provide refunds for partially used billing periods or one-off payments. Refunds will generally not be issued once payment has been processed and confirmed, a service has been delivered, or a subscription activated.
- Exceptions to refund may however apply where required by applicable consumer protection laws, or where delivery of a purchased product has failed for over fourteen (14) calendar days, attributable to technological failures from our end only (NOT from a third party service provider). Refund requests should be directed to support@firstfive.cc within 14 days of the relevant charge.
3.4. Price Changes
We reserve the right to change prices and subscription fees at any time. We will provide at least 7 days' notice of any price change to existing subscribers and businesses in our directory via email. Continued use of the platform and/or purchase of services after the notice period constitutes acceptance of the new costs.
SECTION 4: LIMITATION OF LIABILITY & INDEMNIFICATION
FirstFive Magazine is not responsible for business performance, client disputes, financial losses, or service delivery quality. Advertisers are solely responsible for the accuracy of their claims, legal compliance, product/service quality, and intellectual property rights.
- To the fullest extent permitted by applicable law, FirstFive Magazine, its officers, directors, employees, agents, and affiliates shall not be liable for: (a) any indirect, incidental, consequential, special, or punitive damages; (b) loss of opportunity, profit, data, reputation, or goodwill; (c) the content or accuracy of third-party opportunity listings; (d) reliance by you on any AI Output; or (e) any interruption, suspension, or termination of the Platform. Where liability cannot be excluded by law, our total aggregate liability to you for any claim arising under or in connection with this Agreement shall not exceed the total fees paid by you to FirstFive Magazine in the 12 months immediately preceding the event giving rise to the claim
- You agree to defend, indemnify, and hold harmless FirstFive Magazine and its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of or access to the Platform; your breach of this Agreement, or any applicable law; any Content you upload, submit, or transmit through the Platform; any misrepresentation made by you; or your infringement of a third party's intellectual property or privacy rights.
- We reserve the right to assume exclusive control of the defence of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with us in asserting any available defences.
SECTION 5: EFFECTIVE DATE & TERMINATION
5.1 Effective Date
These Terms take effect when you first access or use our advertising and listing services, and remain in force until your payment period is completed, your subscription canceled, or this Agreement is otherwise terminated in accordance with this section. Upon termination, your right to access and use our services ceases immediately. Provisions of this Agreement that by their nature should survive termination — such as intellectual property rights, disclaimers, limitation of liability, indemnification, and governing law — shall survive.
5.2. Termination by You
You may terminate your recurring subscription at any time by deleting your account through the Platform settings or by sending a written request to terminate. Termination by you does
not entitle you to a refund of subscription fees except under the circumstances provided in Section 3.3(c) of this agreement.
5.3. Suspension or Termination by FirstFive Magazine
We reserve the right to suspend or terminate your account, with or without notice, if:
- You breach any provision of these terms;
- We are required to do so by law or a court or regulatory order;
- Your use of the Platform poses a security risk or could harm other users;
- We elect to discontinue the Platform or a material part thereof without any particular cause
- Advertised content violates our policies, receives complaints, or is deemed harmful or misleading.
SECTION 6: AMENDMENTS TO THIS POLICY
We may update this Agreement from time to time to reflect changes in our practices, applicable law, or regulatory guidance. When we make material changes, we will update the 'Effective Date' at the top of this document, notify you via email or a prominent notice on the platform, and where required by law, seek your renewed consent. If you do not agree with any updated Terms, you must stop using our services before the updated Terms take effect. Continued use of our advertising and listing services after the effective date of any amendment constitutes your acceptance of the revised Terms.
SECTION 7:GENERAL PROVISIONS
7.1 Entire Agreement
This Policy, together with the Terms of Use constitute the entire agreement between you and FirstFive Marriage World Ltd regarding our advertising and listing services, and supersede all prior agreements, representations, and understandings.
7.2 Severability
If any provision of this Policy is found to be invalid, unlawful, or unenforceable by a competent court, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
7.3 No Waiver
Failure by either party to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.
7.4 Assignment
You may not assign, transfer, or sub-licence your rights under this Agreement without our prior written consent. We may assign our rights and obligations under this Policy to any successor or affiliate entity upon notice to you.
7.5 Force Majeure
Neither party shall be liable for any failure or delay in performance caused by circumstances beyond their reasonable control, including acts of God, government action, civil unrest, cyberattacks, or failure of third-party infrastructure.
7.6 Language
This Agreement is drafted in English. In the event of any conflict between this English version and any translation, the English version shall prevail.
7.7 Electronic Notices
You agree to receive all communications from FirstFive Marriage Ltd. electronically, including via email or notices posted on the Platform.
SECTION 8: GOVERNING LAW & JURISDICTION
This Policy is governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising in connection with this Policy shall be subject to the jurisdiction of the competent courts of Nigeria. Users in other jurisdictions also retain rights under their applicable local laws, which we respect and comply with to the extent required.
