TERMS OF USE

These Terms of Use ("Terms", “Agreement”) constitute a legally binding agreement between you ("User", "you", or "your") and Firstfive Marriage World Ltd ("we", "our", or "us") governing your access to and use of the FirstFive Magazine website, webzine, online store, business directory, downloadable publications, digital media, social media channels, and related services (“the platform”, “Our platform”, “FirstFive”, “FirstFive Magazine”). By accessing or browsing our platform, registering for an account, purchasing products, submitting content, listing a business, or otherwise using our services, you confirm that:

• You have read, understood, and agree to be bound by these Terms and our Data Privacy Policy;
• You are at least 18 years of age, or with verifiable parental or guardian consent;
• You have the legal capacity to enter into a binding agreement under the laws of Nigeria, and;
• Where you are accessing the Platform on behalf of an organisation, you have authority to bind that organisation to these Terms.

SECTION 1: OUR PLATFORM

1.1. What We Offer

FirstFive Magazine is a Christian publication focused on grooming the first five years of love, marriage, and parenting. Purchases may include:

• Digital magazines
• PDF publications
• Audio editions
• MP3 files
• WAV files
• Downloadable resources

Purchases grant a personal, non-exclusive, non-transferable license. Products purchased may however not be shared, resold, redistributed, uploaded to file-sharing websites, or used for commercial redistribution

1.2. Business Directory, Advertising and Promotional Features 

FirstFive offers Directory listings as paid placements. Businesses are responsible for the accuracy of submitted information. We reserve the right to approve, reject, edit, suspend, or remove listings at our sole discretion, and we do not guarantee leads, customers, revenue, business growth, or search visibility through listings. Sponsored content and paid promotions may also appear on our website, magazine, directory, newsletters, and social media platforms. Publication of advertising does not constitute our endorsement; Advertisers are solely responsible for the accuracy and legality of their claims. Please refer to our Business Directory and Advertising Policy for more information on our terms of use for promotional content.

 1.3 Platform Access & Modifications 

1. We aim to provide uninterrupted access to the Platform but do not guarantee that the Platform will be available at all times, error-free, or free from interruptions. Scheduled maintenance, force majeure events, or technical faults may result in temporary unavailability. We will endeavour to provide advance notice of scheduled downtime where reasonably practicable.
2. We reserve the right to modify, update, discontinue, or introduce new features on the Platform at any time, with or without notice. Continued use of the Platform following any modification constitutes acceptance of the updated service.

SECTION 2: ACCOUNT REGISTRATION & SECURITY 

2.1. Eligibility

You must be at least 18 years of age to register for an account without a parent’s or guardian’s supervision. Users younger than 18 may register only with verified parental or guardian consent. We reserve the right to verify age and identity at any time and to suspend accounts where eligibility requirements are not met.

2.2 Registration Obligations

When creating an account, you agree to provide accurate, current, and complete information. You must promptly update your information if it changes. You may not:

• Create an account on behalf of another person without their express authorisation:
• Register using an identity or name that infringes any third party's rights;
• Register using false, misleading, or fraudulent information; or
• Create multiple fake accounts.

2.3 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect any unauthorised access to or use of your account. We will not be liable for any loss resulting from unauthorised use of your account.

SECTION 3: ACCEPTABLE USE AND USER OBLIGATIONS 

3.1 Permitted Use

You may use the Platform solely for your own personal, non-commercial development, unless you have entered into a separate written agreement with us for commercial or institutional use. You agree to use the Platform in good faith and in compliance with these Terms and all applicable laws. To use the platform as a columnist or editor, visit our Columnist and Editors Terms of Use. 

3.2. User Submissions

Users may submit Articles, Testimonials, Comments, Business information, Photos, and such other materials to be published on the platform. By submitting content, you grant FirstFive Magazine a worldwide, royalty-free, perpetual license to publish, reproduce, distribute, modify, and display such content. 3.3 Content Standards

While we welcome a diverse audience, all content, community participation, directory listings, and submissions must respect our Christian values and mission. We reserve the right to reject content or listings that conflict with our mission.You are solely responsible for all information and content you upload. 

3.4 Prohibited Conduct

You must not, directly or indirectly:

• Upload false, misleading, fraudulent, or plagiarised Content, including fabricated credentials, publications, or writings. By using the site, you warrant that your information is accurate and truthful to the best of your knowledge, does not infringe the intellectual property rights of any third party nor contain unlawful, defamatory, obscene, or offensive material.
• Use the Platform to impersonate any person or organisation, or misrepresent your identity or affiliation;
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of any part of the Platform;
• Scrape, crawl, or systematically extract data from the Platform using automated tools without our written consent;
• Reproduce, redistribute, sell, sub-license, or commercially exploit any content without our prior written consent;
• Introduce or transmit any virus, malware, Trojan horse, worm, or other harmful code;
• Attempt to gain unauthorised access to the Platform's systems, databases, or other users' accounts;
• Use the Platform to harass, abuse, or harm any person;
• Engage in any activity that circumvents or disables security features of the Platform;
• Use the Platform in any way that could damage its reputation or bring FirstFive into disrepute.

SECTION 4: INTELLECTUAL PROPERTY RIGHTS 

4.1 FirstFive’s Intellectual Property

All content on the Platform that is not User Content—including but not limited to the FirstFive name, logo, brand identity, website design, software, algorithms, matching engine, AI models, database architecture, opportunity listings, and all associated Intellectual Property—is owned by or licensed to FirstFive Marriage Ltd., and protected under intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our Intellectual Property beyond the limited licence to use the Platform as described herein. You must not:

• Use our trademarks, logos, or brand elements without express written authorisation;
• Copy, reproduce, or distribute any Platform content without our prior written consent;
• Create derivative works based on the Platform's software, design, or AI systems; or
• Remove, obscure, or alter any proprietary notices, labels, or marks on the Platform.

If you provide suggestions, feedback, or ideas regarding the Platform ("Feedback"), you grant FirstFive Magazine a perpetual, irrevocable, royalty-free, worldwide licence to use, incorporate, and commercialise such Feedback without any obligation to compensate you. Providing Feedback does not create any employment, partnership, or agency relationship.

4.2. Ownership of User Content

1. You retain full ownership of all intellectual property rights in the content you upload to the Platform. These Terms do not transfer ownership of your content to us. However, by uploading or submitting information to the Platform, you grant FirstFive Marriage Ltd a non-exclusive, worldwide, royalty-free, sublicensable licence to process, analyse, and use your information solely for the purpose of providing the Platform's services to you, generate AI outputs and store and back up your information for operational continuity. This licence is limited to the purposes described above. We will not use your information to train AI models for any third party, or for any purpose beyond operating and improving the Platform's core matching and analysis services, without your separate and explicit consent.
2. You may delete your information or close your account at any time through your account settings. Upon deletion, we will remove your information from active systems within 30 days, subject to any retention obligations under applicable law. Residual copies in backup systems will be purged in the ordinary course of our backup cycle

4.3. Aggregated and Anonymised Data

We may use anonymised, aggregated, and de-identified data derived from Platform activity to improve our algorithms, conduct research, and develop new features. Such data cannot be used to identify you personally and does not constitute use of your information beyond the licence granted above.

SECTION 5: SUBSCRIPTION, PRODUCTS AND PRICING

5.1. Free and Paid Tiers 

 The Platform offers both a free tier with limited features and paid subscription plans that unlock premium functionality. The features available under each tier are set out on our Pricing page and may be updated from time to time. Subscription fees for paid tiers are charged in advance on a monthly or annual basis, as selected by the user at checkout.

5.2. Digital Products

Digital products are available for purchase in the form of PDF magazines, Audio magazines, MP3 files, WAV files, Downloadable resources, Bundled digital content, etc. These products are not accessible upon subscription to the platform; they are purchased seperately at the user’s discretion. By purchasing any digital product, you agree to our pricing and payments policy as set out in this section and on our pricing page. 

5.2. Pricing and Payment Process

1. The prices of products and subscrtiption tiers are set out on our Pricing page, and may be updated from time to time. All subscription fees and product costs are stated in the currency displayed at the time of purchase. Taxes will be added to the subscription fee, and a total will be deduced at checkout. Promotions or discounts on any product do not apply retroactively.
2. Payments are processed by third-party payment providers. By providing your payment details, you authorise us to charge the applicable fee to your selected payment method. We do not store your full payment card details; these are handled securely by our payment processor under PCI-DSS compliant standards.

5.3. Electronic Delivery

All products sold on this platform are digital and delivered electronically. No physical items will be shipped. Delivery may occur via:

• Direct download links
• Email delivery, or 
• User account access

To access your purchase after payment, it is your responsibility to ensure a correct email address is provided, download and store purchased files securely, and maintain the credentials of your account in order to access products that can only be viewed on your portal. We are not responsible for lost downloads after delivery. 

5.4. License

Upon purchase, you are granted a personal, non-exclusive, non-transferable, revocable licence to the item purchased. You may access and use the content for personal or internal use only. You may NOT share files with others, resell or redistribute content, upload to file-sharing platforms, use content for commercial redistribution, or claim ownership of purchased content. 

5.5. Refund Policy

1. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date. 
2. We do not provide refunds for partially used billing periods or digital products. Refunds will generally not be issued once a download link has been accessed, a file has been delivered, a product has been made available in your account, or a subscription activated.
3. Exceptions to refund may however apply where required by applicable consumer protection laws, or where delivery of a purchased product has failed for over fourteen (14) calendar days, attributable to technological failures from our end only (NOT from a third party service provider). Refund requests should be directed to support@firstfive.cc within 14 days of the relevant charge.

5.6. Price Changes

We reserve the right to change subscription fees and product prices at any time. We will provide at least 7 days' notice of any price change to existing subscribers and purchasers via email. Continued use of the platform and/or purchase of products after the notice period constitutes acceptance of the new costs. 

SECTION 6: LIMITATION OF LIABILITY 

6.1. Disclaimer

1.  FirstFive Magazine is an intelligence and strategy tool, not a guarantee of success. The Platform and all content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. We make no representation, warranty, or undertaking that any content will be accurate, complete, up-to-date, or suitable for your particular circumstances. 
2. Our content is designed to inform and support you, not to replace your judgment, professional advice, or worldview. We therefore do not guarantee any outcomes related to marriage success, parenting results, relationship improvements, business success from directory listings, and engagement from advertising. 
3. We are not responsible for the validity or legality of guest contributor content, directory listings, advertiser claims and external website links. Your reliance on content or third-party websites and services is strictly at your own discretion. 
4. All content generated directly by FirstFive Magazine is for informational and educational purposes only, and is advisory in nature. It is not:

• Professional medical advice
• Professional legal advice
• Psychological counselling
• Professional financial advice
• Professional therapy or diagnosis
